“Photographer” or “We” means “Click ART Photography”, “Client” or “You” means the commissioning party, its representatives or the person named as client. Click ART Photography shall own the copyright for all images created and shall have exclusive right to make reproductions. Click ART Photography shall only make reproductions for the Client or for the Photographer’s portfolio(including internet website), studio samples, self promotions, entry in photographic contests or exhibitions, instructional purposes, editorial use, as samples of work to be shown to prospective clients or as samples of work to be displayed for marketing. We will not make reproductions for other use without first obtaining written permission from the Client. Payment A non-refundable deposit of 50% of package along with a completed contract will reserve the Photographer for coverage on the specified date and will be applied to the Package. The remaining balance is DUE on the day of the event. Upon acceptance of these terms, the Photographer reserves the time and date for Client and will NOT make any other reservations for that time. For this reason, the deposit is non-refundable, even if Client cancels the order for photography, or changes the date of the event.
Photographer may be limited by the guidelines or rules of the ceremony official, ceremony venue, or reception venue. Client understands and agrees the Photographer will abide by such guidelines or rules and that they are outside the control of Photographer. Client agrees to hold Photographer harmless for the impact such guidelines or rules may have on the finished product.
While Click ART Photography will make every effort possible to take specifically requested photos, the Client understands that a wedding is an uncontrolled, dynamic and fast moving event and that due to the varieties of the weather, available light, and willingness or availability of subjects, Click ART Photography cannot guarantee that any particular requested photo will be taken. It is the Client’s responsibility to see that the persons to be photographed are available, on time and cooperative.
In the unlikely event of total photographic failure, injury or sickness beyond Click ART Photography control, Click ART Photography liability shall be limited to a full refund of any deposits and fees paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer. Client agrees that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits Photographer’s liability to the amount paid.
